Decorative Baskets
CBP is proposing to reclassify decorative storage baskets as other made-up articles under HTSUS 6307.90.98 (7 percent duty) rather than as articles of twine or cordage under HTSUS 5609.00.1000 (2.9 percent duty) or 5609.00.3000 (4.5 percent duty). Rulings NY N328585 and NY N326486 would be modified to reflect this change.
The items at issue are decorative storage baskets designed and intended for use in the home. One basket is made of a 100 percent polyester nonwoven fabric sheathed with a 100 percent cotton braided yarn, while the other is made of 100 percent polypropylene nonwoven fabric sheathed with a 68.5 percent polyester and 31.5 percent cotton polyester braided rope. The baskets are constructed by winding the braided yarn or rope and sewing each layer together.
CBP explains that these baskets are not classifiable in heading 5609 because their braided components are not tightly plaited and do not have a compact structure. Instead, the baskets are “made up” within the meaning of Note 7(f) to HTSUS Section XI because they are assembled by sewing the braids together.
Pork Jowls
CBP is proposing to reclassify pork jowls as edible offal of swine under HTSUS 0206.30.0000 (fresh) or 0206.49.0000 (frozen) rather than as meat of swine under HTSUS 0203.19.4090 (fresh) or 0203.29.4000 (frozen). All of these subheadings are duty-free. Ruling NY 864034 would be revoked to reflect this change.
