pattern

U.S. federal law restricts certain government purchases to goods and services that comply with U.S. preference or domestic content requirements, including the Buy American Act of 1933 (BAA), the Trade Agreements Act of 1979 (TAA), and various executive agency specific “Buy America” laws and regulations. With increased focus on these rules, companies selling directly to the federal government – and those serving as subcontractors, sub-tier subcontractors, or suppliers in federal government procurements – must comply with ongoing developments to sell to the government.

ST&R offers the following services to help with your compliance:

  • Provide company-specific training regarding BAA, TAA, and other “Buy America” requirements, including compliance related to specific product offerings;
  • Review strategic product sets/SKUs to determine BAA/TAA eligibility and compliance;
  • Prepare and submit country of origin determination rulings to U.S. Customs & Border Protection (CBP) for specific products/SKUs to determine whether a substantial transformation occurred in a TAA-designated country, and therefore, whether the product is TAA compliant; and
  • Review contract terms and conditions related to specific product or service offerings to determine BAA/TAA/Buy America applicability.
