Background

The Bureau of Industry and Security has issued a notice that makes a change to a presidential proclamation adjusting Section 232 tariffs on imports of steel, aluminum, and copper.

Specifically, this notice adds subheading 9903.82.01 to the HTSUS to be used for goods that are imported under an HTSUS provision covering articles or derivatives of steel, aluminum, or copper but do not contain any of those metals and are therefore not subject to applicable Section 232 tariffs. This change is effective with respect to subject goods entered or withdrawn from warehouse for consumption on or after 12:01 a.m. EDT on April 6, 2026.

The notice further clarifies that (1) United Kingdom-origin steel made by Tata Steel UK that contains steel for which the reported country of melt and pour is the Netherlands may continue to be imported under the lower Section 232 steel tariff rate for UK-origin steel and may be declared under HTSUS 9903.82.04 until Jan. 1, 2028, and (2) U.K.-origin steel articles made by Tata Steel UK for which the reported country of melt and pour is the Netherlands may count toward the 95 percent of steel melted and poured under note 16(d) of the HTSUS (with respect to products under subheadings 9903.82.04 and 9903.82.05) until Jan. 1, 2028.
