The Export Administration Regulations affect exports of goods made or located in the U.S., but did you know they can also apply to goods manufactured outside the U.S.? Companies doing business internationally should have a clear understanding of whether their goods are covered by the EAR and the implications that determination has on their export compliance obligations. Join ST&R for a discussion of the four circumstances under which an item falls under the coverage of the EAR: 1) U.S.-origin items; 2) items physically located in the United States; 3) items with de minimis controlled U.S. content; and 4) items that are assembled abroad using U.S. technology or software under the foreign direct product rules. We will also discuss what legal obligations still apply to transactions where the EAR does not apply.
