Join us for a webinar analyzing the Supreme Court’s decision to strike down the tariffs imposed under the International Emergency Economic Powers Act (IEEPA). Our speaker will break down the Court’s decision that the statutory authority to “regulate importation” under IEEPA does not include the power to set tariff rates, and the Court’s rejection of the government argument that national emergencies justify expanding presidential tariff authority beyond those statutory limits.

The discussion will also examine the separate concurring and dissenting opinions, including the Justices’ differing views on the major questions doctrine, legislative history, and the potential continued use of other tariff statutes such as Section 232 of the Trade Expansion Act and Sections 201, 301, and 122 of the Trade Act of 1974.

Finally, the webinar will focus on what comes next. With the case returning to the Court of International Trade, significant questions remain regarding remedies, including whether—and how—refunds of invalidated IEEPA tariffs will be processed. As several Justices noted, the refund process could be complex and disruptive, with billions of dollars potentially at stake.
