Background

The Consumer Product Safety Commission has issued a direct final rule updating the mandatory safety standard for gates and enclosures to incorporate by reference voluntary standard ASTM F1004-21, which is the first revision made to ASTM F1004 since it was incorporated into the CPSC’s July 2020 final rule for gates and enclosures.

Based on a review of the revised voluntary standard, the CPSC will allow it to become the mandatory standard for gates and enclosures without modification because the revised performance requirements are identical to those set forth in 16 CFR 1239. The revised standard will be effective as of Jan 2, 2022, unless significant adverse comment is received by Oct. 28, 2021, in which case it will be withdrawn.
