Background

The Drug Enforcement Administration has issued a proposed rule that would extend the time allowed for reexports of controlled substances outside of the European Economic Area from 180 days from the date of original release from U.S. Customs and Border Protection to 365 days from that original release date.

DEA explains that the 180-day limit has not been sufficient for companies to perform logistical operations needed for reexportation, such as storing and moving exports. Compliance with this limit can be infeasible because of manufacturing issues, geopolitical issues like closures of airspace, facility licensing delays, and the inability to fulfill back orders.

Electronic comments on this proposal must be submitted, and written comments must be postmarked, on or before Nov. 30.
