The following proposed revocations and modifications of U.S. Customs and Border Protection rulings are included in the Oct. 30, 2024, Customs Bulletin and Decisions. Comments on these proposed changes are due by Nov. 30.

Wood Chippers

CBP is proposing to reclassify wood chipping/shredding machines as forestry machinery under HTSUS 8436.80.0020 (duty-free) rather than as other machinery under HTSUS 8436.80.0090 (duty-free). Rulings NY N114998, NY 807222, and NY 801876 would be revoked, and rulings NY N297986, and NY 897172 would be modified, to reflect this change.

The products at issue are machines designed to chip and shred various organic materials, from small pieces of garden debris and cuttings to entire trees. CBP states that these machines use and manage forest resources and are therefore considered forestry machines.

Plastics Recycling Plant

CBP has previously classified a plastics recycling plant as other machinery for the treatment of materials under HTSUS 8419.89.95 (4.2 percent duty). CBP is now proposing to hold that the subject plant consists of two functional units, one of which is properly classified in the current subheading while the other is classified as a distilling or rectifying plant under HTSUS 8419.40.00 (duty-free). Ruling HQ H322641 would be revoked to reflect this change.

The product at issue is a plastics recycling plant assembled in a foreign-trade zone that will be entered into the U.S. upon completion of the assembly process. It consists of an integrated combination of 12 individual components connected by piping, wiring, and structural steel that operate in a continuous flow. Once assembled and operational the plant will recycle post-consumer and post-industrial plastics with high levels of polyethylene terephthalate by refining and reclaiming chemical products such as polymer-grade ethylene glycol and dimethyl terephthalate. The plant will be constructed using certain domestically sourced and imported components.
