Background

U.S. Customs and Border Protection has issued a final determination concerning the country of origin of meeting tables that may be offered to the U.S. government. Any party-at-interest may seek judicial review of this determination by June 23.

According to CBP, the items at issue are two models of meeting tables, each of which is offered in different sizes, base finishes, and laminate and veneer tabletop finishes. The table surfaces are manufactured in Canada, aluminum components from China are painted and assembled in Canada, and all of the individual components are shipped to the U.S. for final assembly.

In ruling HQ H338728 CBP concludes that the country of origin of the tables will be Canada for purposes of U.S. government procurement. CBP explains that the tabletop manufactured in Canada imparts the essential character of the imported product and that the assembly operations completed in the U.S. are not substantial.

CBP issues country of origin advisory rulings and final determinations as to whether an article is or would be a product of a designated country or instrumentality for the purposes of granting waivers of certain “Buy American” restrictions in U.S. law or practice for products offered for sale to the U.S. government.
