Tariff changes, trade remedy proceedings, and export controls are among the topics of rules appearing on the Department of Commerce’s most recent semiannual regulatory agenda, which lists pending agency regulations affecting international trade.
Short-term actions
The following rules are expected to be issued within the next year.
- a proposed rule to add a conditional data element, country of origin, when the foreign indicator is selected in the electronic export information through the Automated Export System
- a proposed rule regarding the potential codification and revision of (1) the current policy in antidumping duty proceedings of assessing entries of subject merchandise exported by unaffiliated resellers at the “all others” rate determined in an AD investigation rather than the rate calculated for an examined producer in an administrative review, and (2) the analysis conducted to determine if it is appropriate to apply an average-to-transaction comparison methodology in AD investigations and certain administrative reviews; this rule would also modify or remove a regulatory provision providing for the conduct of an expedited administrative review following the conclusion of a countervailing duty investigation (ANPR issued in June 2025)
- a final rule establishing a process for including additional auto parts articles for passenger vehicles and light trucks within the scope of Section 232 tariffs on autos (interim final rule issued in September 2025)
- a proposed rule that would (1) amend seafood import permitting, reporting and recordkeeping, and entry filing requirements and (2) provide for the revocation of a certification of admissibility if exporting nation officials do not exercise due diligence in documenting the origin of fishery products shipped to the U.S. (ANPR issued in July 2022)
- a proposed rule implementing export controls on certain critical technologies
- a proposed rule to simplify the requirements for license exception STA (strategic trade authorization) and make other changes to encourage additional use of this exception
- a final rule to clarify export controls on radiation-hardened integrated circuits and computer and telecom equipment incorporating such circuits (proposed rule published March 2024)
- a proposed rule to control U.S. persons’ support of military and intelligence end-users and end-uses and restrict exports, reexports, and transfers (in-country) to these end-users and end-uses
- a final rule to remove license requirements for most exports, reexports, and transfers (in-country) to Australia and the United Kingdom of items subject to the Export Administration Regulations (interim final rule issued in April 2024)
- a final rule establishing new rules for the secure export of advanced artificial intelligence chips (interim final rule issued in January 2025)
- a final rule to impose new export controls on certain biotechnology equipment and revoke controls on high-parameter flow cytometers (interim final rule issued in January 2025)
- a final rule implementing additional export controls on advanced computing and semiconductor manufacturing items (interim final rule published October 2022)
- a final rule implementing export controls on quantum computers, materials, and related electronic assemblies; additive manufacturing equipment designed to produce metal or metal alloy components; technology for the development or production of coating systems; software that aids in the reverse engineering of integrated circuits; and technology for the development or production of integrated circuits or devices using gate all-around field-effect transistor structures (interim final rule issued September 2024)
- a final rule revising export controls for certain advanced computing items, supercomputers, and semiconductor manufacturing equipment, which includes (1) adding new controls for certain semiconductor manufacturing equipment and related items, (2) creating new foreign direct product rules for certain commodities to impair the capability to produce advanced-node integrated circuits by certain destinations or entities of concern, (3) adding new controls for certain high-bandwidth memory important for advanced computing, and (4) clarifying controls on certain software keys that allow for the use of items such as software tools (interim final rule issued December 2024)
- a final rule expanding export restrictions to many subsidiaries of entities on two federal lists to address diversion concerns involving listed entities (interim final rule issued in October 2025)
Long-term actions
The following are listed as long-term actions, meaning they are still under development and not expected to see regulatory action within the next 12 months.
- a proposed rule to establish a licensing process for entities to seek pre-approval before engaging in or continuing to engage in potentially regulated information and communications technology and services transactions
- a proposed rule to impose export controls on information and communications technology and services that are designed, developed, manufactured, or supplied by entities under the ownership or control of, or subject to the jurisdiction or direction of, a foreign adversary
- an interim final rule regulating exports of information and communications technology and services integral to unmanned aerial systems (ANPR issued in January 2025)
- a final rule easing export controls for space-related goods (interim final rule issued October 2024)
- a final rule providing additional due diligence procedures regarding advanced computing integrated circuits (interim final rule issued in January 2025)
- an interim final rule regarding the process for including additional steel and aluminum derivative articles within the scope of Section 232 tariffs on such goods (previous interim final rule issued in May 2025)
- a proposed rule regarding export controls on information and communications technology and services designed, developed, manufactured, or supplied by persons owned by, controlled by, or subject to the jurisdiction or direction of certain foreign adversaries and that are integral to large connected vehicles
- an interim final rule addressing risks posed by classes of transactions involving information and communications technology and services that are designed, developed, manufactured, or supplied by persons owned by, controlled by, or subject to the jurisdiction or direction of certain foreign adversaries and that are integral to communications and networking devices, potentially such as small office/home office routers
- a final rule revising the Export Administration Regulations for certain rare earth minerals and strategic metals
- an interim final rule addressing risks posed by certain transactions involving data centers
- a final rule implementing worldwide export controls on high-entropy alloy or refractory metals and alloys powders for additive manufacturing; electronic assemblies, modules, or equipment containing one or more user-configurable field programmable logic devices having specified parameters; semiconductor deposition equipment for tungsten fill or ruthenium layer meeting specified parameters; and telecommunications network surveillance systems, equipment, or components meeting specified parameters for national security and foreign policy reasons
- a final rule that (1) expands current license exceptions and adds new ones and (2) makes corrections and clarifications for electronic export information filing requirements in the Automated Export System
- a final rule allowing prior U.S. government review of exports and reexports of certain strategic commodities to assess the risk of diversion to destabilizing military activities
- an interim final rule that (1) implements export controls on certain silencers, mufflers, and sound suppressors that no longer warrant control on the U.S. Munitions List, (2) adds flash suppressors to the Commerce Control List, (3) allows firearms and related items to be temporarily exported and reexported under a license exception as tools of trade, and (4) clarifies which items fall within the scope of the entry clearance requirements for a temporary import
- an interim final rule establishing a process for including additional derivative copper articles within the scope of Section 232 tariffs on such goods
