Background

The following proposed revocations of U.S. Customs and Border Protection classification rulings are included in the July 1, 2026, Customs Bulletin and Decisions. Comments on these proposed changes are due by July 31.

Aromatherapy Item

CBP is proposing to reclassify a home aromatherapy plush item as a vegetable product under HTSUS 1404.90.90 (duty-free) rather than as a made-up article under HTSUS 6307.90.9889 (7 percent duty). Ruling NY N266860 would be revoked to reflect this change.

The product at issue is a plush item used to provide aromatherapy. It is constructed from 100 percent acrylic pile fabric and filled with flax seed infused with lavender essential oil. The item is heated in the microwave to release the essential oil.

CBP finds that this item is a composite good and that its essential character is imparted by the flax seed component, which thus determines the classification of the entire item. CBP explains that the primary function of the item is to provide a therapeutic effect by causing a warming sensation along with the release of essential oil, which is achieved by heating the flax seed component in the microwave. In contrast, the textile component serves simply as a cover designed to hold the flax seeds.

Aircraft Part

CBP is proposing to reclassify a nut tube assembly as a part of a machine with an individual function under HTSUS 8479.90.95 (duty-free) rather than as an aircraft part under HTSUS 8803.30.0030 (duty-free). Ruling NY N266860 would be revoked to reflect this change.

The product at issue is installed into the air intake actuator for the auxiliary power system used on a specific commercial airplane. It consists of the nut and tube components, permanently assembled together, to be imported as a matched set. These components are manufactured of 15–5 stainless steel alloy for the tube and aluminum nickel-bronze for the nut.
