Background

The International Trade Commission has issued a final rule that, effective Feb. 3, will amend its rules of practice and procedure concerning rules of general application, safeguards, antidumping and countervailing duty investigations, and section 337 adjudication and enforcement. The ITC states that the intended effect of these amendments is to facilitate compliance with these rules, improve the efficiency of agency proceedings, and reduce burdens and costs on both the ITC and parties to these proceedings.

One of the primary changes in this rule is to require all documents to be filed electronically and eliminate the requirement to submit paper copies in most cases. There are also numerous other changes with respect to the initiation and conduct of investigations, petition filings, preliminary and final determinations, sunset reviews, discovery, hearings and conferences, temporary relief, sanctions, protective orders, and enforcement.
