Background

US Customs and Border Protection has updated its Frequently Asked Questions on Forced Labor generally,  and in reference to the Uyghur Forced Labor Prevention Act specifically. CBP has also updated its ACE Protest module to automate Uyghur Forced Labor Prevention Act (UFLPA)-related reviews. Protest filers will notice changes to the ACE Protest user interface (UI), both for UFLPA Exception Reviews, and for UFLPA Applicability Reviews. Exception Reviews require filers to provide “clear and convincing evidence” that their products were not made with forced labor, while Applicability Reviews require filers to prove that their sourcing chain does not include any sourcing from the Xinjiang region or from an entity on the UFLPA Entity List. CBP has also recently updated its Forced Labor website, including links to explanatory fact sheets, videos and statistical information.
