In the Feb. 12, 2025, Customs Bulletin and Decisions, U.S. Customs and Border Protection is reclassifying training pants as sanitary pads under HTSUS 9619.00.61 (10.8 percent duty), 9619.00.64 (14.9 percent duty), or 9619.00.74 (16 percent duty) rather than as women’s or girls’ briefs under HTSUS 6108.21.00 (7.6 percent duty), 6108.22.90 (15.6 percent duty), or 6208.92.00 (16 percent duty) or as babies’ garments under HTSUS 6111.30.50 (16 percent duty).
Ruling HQ H325601 will revoke rulings NY N244949, NY N237226, NY N212877, NY N189364, NY N051615, NY N047756, HQ 965891, HQ 962542, NY E85902, and NY E85172, and modify rulings NY I89181, NY I83963, HQ 960319, to reflect this change, effective with respect to goods entered or withdrawn from warehouse for consumption on or after April 12.
The products at issue are toddler-sized training pants composed of various materials. The essential character of each is imparted by the absorbent material that holds moisture in.
CBP explains that while training pants have historically been classified in HTSUS Chapters 61 or 62 as articles of apparel, heading 9619 (providing for pads, tampons, diapers, diaper liners, and similar articles) was introduced in 2012 and the items at issue are classifiable as articles similar to those named in that heading, primarily because they have an absorbent core.
