Some imports of aluminum extrusions and profile products and derivatives could be seized and forfeited following a new finding that such goods are being made with forced labor. These products are widely used to build transportation and construction products, furniture, electronics, and other goods.
U.S. Customs and Border Protection has authorized port directors to seize and commence forfeiture proceedings against the following products unless the importer establishes by satisfactory evidence that they were not produced or manufactured in any part with the use of forced labor.
- aluminum extrusions and profile products and derivatives produced or manufactured wholly or in part with aluminum and articles thereof classified under HTSUS subheadings 7604.21.0010, 7604.29.1010, 7604.29.3060, 7604.29.5050, 7604.29.5090, 7608.20.0090, 7610.90.0080, and any other relevant subheadings under Chapter 76 that are produced or manufactured wholly or in part by Kingtom Aluminio S.R.L., a Chinese-owned entity in the Dominican Republic
This authorization applies to subject goods that (1) are imported on or after Dec. 4 or (2) have already been imported but were not released from CBP custody before Dec. 4. Once seized, subject goods may not be exported from the U.S.
CBP took this action after determining that there is sufficient information to support a finding that Kingtom is using convict, forced, or indentured labor in a factory in the Dominican Republic to produce these goods and that they are being, or are likely to be, imported into the U.S.
