Tariffs. H.R. 6318 (introduced Nov. 28 by Rep. DeLauro (D-Conn.) would prohibit price gouging with respect to goods subject to a tariff.

Customs. Senate Finance Committee Ranking Member Ron Wyden, D-Ore., sent a letter to Homeland Security Secretary Kristi Noem Nov. 21 to raise “serious concerns” about what appears to be a “manifestly improper use of [the] customs investigatory authority” under 19 USC 1509 to “repress First Amendment protected speech.” That statute authorizes U.S. Customs and Border Protection to “seek records related to the enforcement of customs laws—for example, to obtain records from an importer to determine whether that party paid the appropriate duties and fees on imported merchandise.” However, Wyden asserted, CBP “has a history of improperly using this summons authority to obtain records unrelated to import of merchandise or customs duties,” and in the two cases at issue DHS appears to be using it to try to “expose an individual’s identity in order to chill criticism of the Trump Administration’s immigration policies.”

Export enforcement. H.R. 6302 (introduced Nov. 25 by Rep. Johnson, D-Texas) and H.R. 6322 (introduced Nov. 28 by Rep. Kean, R-N.J.) would establish a whistleblower incentive program with respect to defense exports control enforcement.
