Background

The Department of Commerce’s National Marine Fisheries Service is proposing to revise its regulations regarding a certification of admissibility form that allows entry of certain fish or fish products otherwise subject to certain trade restrictions. Comments on this proposal are due no later than Feb. 18.

NMFS states that several U.S. laws authorize the federal government to impose trade restrictions on certain fish or fish products (both wild-caught and aquaculture) of a foreign nation that has failed to meet U.S. standards or requirements. To allow for entry of similar fish and fish products that are not subject to such restrictions, NMFS developed the COA fish harvest record form, which attests to the method and location of harvest of such fish. NMFS currently uses paper COAs that require the signatures of the certifying official of the exporting nation prior to arrival and the U.S. importer upon release into the U.S.

The proposed rule would automate the COA and provide for electronic entry filing in the Automated Commercial Environment of data from this form. It would also amend and consolidate COA-related permit, reporting and recordkeeping, and entry filing requirements.
