Background

Plastics Recycling Plant

CBP previously classified a plastics recycling plant as other machinery for the treatment of materials under HTSUS 8419.89.95 (4.2 percent duty). CBP now holds that this plant consists of two functional units, one of which is properly classified in the current subheading while the other is classified as a distilling or rectifying plant under HTSUS 8419.40.00 (duty-free).

Ruling HQ H322641 will revoke ruling HQ H322641 to reflect this change, effective with respect to goods entered or withdrawn from warehouse for consumption on or after Oct. 13.

The product at issue is a plastics recycling plant assembled in a foreign-trade zone that will be entered into the U.S. upon completion of the assembly process. It consists of an integrated combination of 12 individual components connected by piping, wiring, and structural steel that operate in a continuous flow. Once assembled and operational the plant will recycle post-consumer and post-industrial plastics with high levels of polyethylene terephthalate by refining and reclaiming chemical products such as polymer-grade ethylene glycol and dimethyl terephthalate. The plant will be constructed using certain domestically sourced and imported components.

Chemical Compound

CBP is reclassifying molybdenum disulfide powder as other mineral substances under HTSUS 2530.90.80 (duty-free) rather than as other polysulfides under HTSUS 2830.90.90 (3 percent duty).

Ruling HQ H342780 will revoke ruling NY N306461 and modify ruling NY 853255 to reflect this change, effective with respect to goods entered or withdrawn from warehouse for consumption on or after Oct. 13.

The item at issue is an inorganic chemical compound with greater than 98 percent purity. It is used primarily in high-temperature lubricants but may also be used as an additive to steel, as well as for its semiconductor properties.
