Background

U.S. Customs and Border Protection reports that on Aug. 12 it deployed an enhancement to the Automated Commercial Environment that will withhold release of de minimis shipments that are ineligible for clearance because the $800 per person/per day threshold has been met.

According to CBP, ACE will withhold release and provide notice when a shipment meets this threshold. The shipment will then need to be linked to a type 01 or 11 entry unless the filer decides to abandon, export, or return to sender.

CBP adds that the threshold calculation will use the consignee field and the actual date of arrival of the conveyance. Date of arrival will be assessed over the 24-hour period from 12:00 a.m. to 11:59 p.m. ET across all ports.

If multiple shipments for the same consignee are on the same conveyance, they will be processed in the order in which they are manifested. Eligibility will be based on aggregated total value of de minimis shipments filed as entry type 86 and those intended to be released off the manifest. If the total exceeds $800, that most recent shipment will be withheld from release. If the consignee has not exceeded the daily threshold, subsequent shipments will be allowed until the threshold is reached. Once the consignee hits the $800 threshold, all subsequent shipments for that consignee for that day are ineligible for de minimis clearance.

As a reminder, President Trump issued July 30 an executive order that will suspend commercial de minimis entries from all countries as of Aug. 29.
