FMC News: Penalties Increased, OTI License Applicants

Penalties Increased. Effective Jan. 15 the Federal Maritime Commission is increasing for inflation the maximum civil monetary penalty amounts for the following regulatory or statutory violations.

- adverse impact on U.S. carriers by foreign shipping practices: from to $2,103,861 to $2,140,973

- violation of 1984 Shipping Act or FMC regulation or order issued thereunder: from $60,039 to $61,098 for knowing and willful violations and from $12,007 to $12,219 for others

- operating in foreign commerce after tariff suspension: from $120,079 to $122,197

- failure to provide required reports: from $9,472 to $9,639

- adverse shipping conditions: from $1,894,261 to $1,927,676

- operating after tariff or service contract suspension: from $94,713 to $96,384

- failure to establish financial responsibility for non-performance of transportation or death or injury: from $23,924 to $24,346

- making false claims or giving false statements in violation of Program Fraud Civil Remedies Act: from $11,463 to $11,665

OTI License Applicants. The FMC has provided notice that the following have filed applications (a) for ocean transportation intermediary licenses as NVOCCs and/or ocean freight forwarders or (b) to amend an existing OTI license or the qualifying individual for a licensee.
