Background

The Department of Justice reports that a Chinese national has been sentenced to 40 months in prison after pleading guilty to conspiring to export military- and space-grade technology to China without a license. 

According to a DOJ press release, the products at issue were radiation-hardened power amplifiers and supervisory circuits. Due to the technological capabilities of these components and the significant contribution they could make to a foreign country’s military and space programs, they required an export license from the Bureau of Industry and Security. In addition, BIS has a policy of denial to export these types of components to China.

DOJ states that between December 2016 and January 2018 the Chinese national used multiple aliases to contact individuals in the U.S., including representatives of U.S.-based private companies, to try to obtain the electronic components. Additionally, he and his co-conspirators agreed to pay a “risk fee” to illegally export the components to China.
