Background

Exclusions from the Section 301 tariffs on imports from China for the following medical care products needed to address the COVID-19 pandemic will expire June 1.

- HTSUS 3923.21.0095 (other plastic sacks and bags for the conveyance or packing of goods)

- HTSUS 5603.14.9090 (other nonwovens, whether or not impregnated, coated, covered, or laminated)

- HTSUS 4818.90.0020/4818.90.0080 (face masks and other sanitary articles)

- protective eyewear (described in HTSUS 9004.90.0010 and 9004.90.0090)

USTR has also extended the tariff exclusions for 77 other products through Sept. 30. These exclusions are available for any product that meets the specified HTSUS numbers and product descriptions, regardless of whether the importer filed an exclusion request. 

In the meantime, USTR is still evaluating comments submitted as part of a review of all Section 301 tariffs on imports from China, which could result in changes to those tariffs at some point.

In addition, efforts to ameliorate the impact of these tariffs are continuing.

- ST&R is advocating for the renewal of all previously approved exclusions and the creation of a process allowing for new exclusion requests (for more information, please contact strdc@strtrade.com).

- There are a number of proven and legitimate ways to effectively avoid the tariffs or limit their impact (click here for more information).

- Importers of List 3 and 4A goods from China can still preserve their rights to possible refunds of tariffs paid on such goods by joining an ongoing court case (for more information, or assistance filing a claim, please contact us at 301Litigation@strtrade.com).
