Background

The following final revocations and modifications of U.S. Customs and Border Protection classification rulings are included in the July 21, 2021, Customs Bulletin and Decisions. These changes will be effective with respect to goods entered or withdrawn from warehouse for consumption on or after Sept. 19.

CBP is reclassifying brass shower and bath drain assemblies as brass sanitary ware under HTSUS 7418.20.10 (3 percent duty) rather than as brass plumbing goods under HTSUS 7419.99.5010 (duty-free). Ruling HQ H306046 will revoke rulings NY N267667, NY N267669, NY N262071, and NY N262072 to reflect this change.

CBP is also reclassifying two plastic basket strainers for a kitchen sink as plastic sanitary ware under HTSUS 3922.90.00 (6.3 percent duty) rather than as other articles of plastic under HTSUS 3926.90.9590 (5.3 percent duty). Ruling HQ H296172 will modify ruling NY 889651 to reflect this change.

In both cases CBP explains that these items are considered sanitary ware (because they are used for the removal of waste from the home) and plumbing fixtures (because they receive and direct wastewater into a sanitary drainage system).
