U.S. Customs and Border Protection has withdrawn a proposal to reclassify metal and rubber automotive air springs and suspension bushings as auto parts and accessories under HTSUS 8708.99.55 (2.5 percent duty) rather than as articles of rubber under HTSUS 4016.99.30 (duty-free), HTSUS 4106.99.35 (3.4 percent duty), or HTSUS 4016.99.55 (2.5 percent duty).
As a result, rulings NY N303345, NY N303352, NY N303355, NY N273173, NY N302641, and NY 811645 will not be revoked, and rulings NY N165423 and NY N300207 will be not be modified, at this time.
The items at issue are automotive vibration control devices made of metal and rubber that provide cushion over uneven surfaces and roads. CBP had proposed to find that these items are classifiable under HTSUS heading 8708 (auto parts) by virtue of the fact that they augment the operation of the vehicles into which they are incorporated. However, after considering comments received, CBP has decided to further consider the classification of these items.
