The Bureau of Industry and Security has issued a final rule that, effective Dec. 26, imposes new controls on exports, reexports, and transfers to or within Pakistan of items listed under ECCNs 1B999, 2A992, 2B999, 3A992, 3A999, and 6A996, which include particle accelerators, certain stainless or alloy pipes and valves, certain pumps and welders, oscilloscopes, chromatographs and spectrometers, and magnetometers. These items may be used in the production of nuclear weapons.
BIS states that under this rule a license will be required for regional stability reasons to export, reexport, or transfer covered items to or within Pakistan. Applications for such transactions will be denied if BIS determines that there is an unacceptable risk of use in an end-use of concern or diversion to an end-user of concern. In addition, the availability of license exceptions will be limited.
BIS explains that it is taking this action after determining that the covered items have been sought by entities on the Entity List as well as front companies acting on their behalf. Controlling these items on a country-wide basis will allow BIS to mitigate the risk of diversion to end-uses or end-users of concern.
