Background

The Federal Maritime Commission recently announced that its maximum civil monetary penalty amounts for specified regulatory or statutory violations will not increase for 2026 and will thus remain as follows.

- adverse impact on U.S. carriers by foreign shipping practices: $2,626,135

- violation of 1984 Shipping Act or FMC regulation or order issued thereunder: $74,943 for knowing and willful violations and $14,988 for others

- operating in foreign commerce after tariff suspension: $149,887

- failure to provide required reports: $11,823

- adverse shipping conditions: $2,364,503

- operating after tariff or service contract suspension: $118,225

- failure to establish financial responsibility for non-performance of transportation or death or injury: $29,864

- making false claims or giving false statements in violation of Program Fraud Civil Remedies Act: $14,308
