Background

The Federal Maritime Commission has announced that ocean common carriers must file documented export strategies with the FMC beginning March 1 and at least annually every following year.

Filings must include information on services offered, markets served, pricing strategies, and equipment provisioning. Submissions must be prospective in nature, providing clear information about how carriers will serve the U.S. export market. Multiple filings in a year are permitted if circumstances warrant.

This requirement was established in an FMC rule prohibiting carriers from unreasonably refusing to accommodate shippers’ attempts to secure overseas transportation for their cargo.

ST&R’s team of former FMC and DOJ litigation personnel, freight forwarders, and former administration and congressional staffers can help shippers understand, comply with, and take advantage of FMC shipping rules.
