The Court of International Trade has announced its plan and schedule for managing litigation seeking to overturn the Trump administration’s Section 301 tariffs of 10-12.5 percent on imports from 86 countries over concerns about forced labor.
Several cases opposing these tariffs have been filed at the CIT (see here for a summary of their primary arguments). The CIT recently issued an order stating that it would proceed first on a representative sample case that it expects will permit the efficient disposition of this litigation while allowing the court to consider all claims raised by the various plaintiffs. Oral argument in this case is currently scheduled for Sept. 30.
To facilitate the proceedings of this case the CIT (1) will establish a master case number under which orders, pleadings, motions, and other documents in related cases will be filed and (2) intends to select a steering committee to aid in the adoption of further case management procedures and the presentation of consolidated briefs and other submissions.
