Shipping Penalties Increased

Effective Jan. 15 the Federal Maritime Commission is increasing for inflation the maximum civil monetary penalty amounts for the following regulatory or statutory violations.

– adverse impact on U.S. carriers by foreign shipping practices: from $2,479,282 to $2,559,636

– violation of 1984 Shipping Act or FMC regulation or order issued thereunder: from $70,752 to $73,045 for knowing and willful violations and from $14,149 to $14,608 for others

– operating in foreign commerce after tariff suspension: from $141,506 to $146,092

– failure to provide required reports: from $11,162 to $11,524

– adverse shipping conditions: from $2,232,281 to $2,304,629

– operating after tariff or service contract suspension: from $111,614 to $115,231

– failure to establish financial responsibility for non-performance of transportation or death or injury: from $28,194 to $29,108

– making false claims or giving false statements in violation of Program Fraud Civil Remedies Act: from $13,508 to $13,946

OTI Licenses Revoked

The FMC has given notice that the following ocean transportation intermediary licenses have been revoked. A revocation may occur after a license is surrendered voluntarily by the OTI or for failure to maintain a valid bond.
