CBP to Advise Filers of Potentially Non-compliant AD/CV Entries

U.S. Customs and Border Protection has announced that on Jan. 16, 2024, it will nationally implement cargo messaging to communicate with the filer on entry summaries that are potentially non-compliant for antidumping and countervailing duties while the entry summaries are in trade control (i.e., prior to submission to CBP). Specifically, CBP is aiming to address AD/CV entry summaries that appear to have omitted companion AD or CV case numbers and/or applied an improper company-specific 10-digit AD/CV case number.

According to CBP, this messaging will be informational only and it will not be mandatory for filers to take action after receiving such a message. However, taking corrective action to address a potentially noncompliant AD/CV issue while the entry is still in trade control may reduce the need for further action by CBP for the identified issue.

CBP states that it will aim to review all entry summaries in trade control for AD/CV compliance issues and provide notification via cargo messaging when concerns are identified. However, regardless of whether or not a filer is notified through a cargo message about AD/CV compliance issues, if CBP identifies any enforcement concerns it may take additional actions to enforce entry summary compliance.
