Labor enforcement has become central to U.S. trade policy in recent years, and environmental issues could soon follow suit. Measures such as the Lacey Act, the U.S.-Peru trade agreement, and most recently the USMCA already link compliance with environmental rules with trade compliance, and there is an emerging bipartisan consensus that weak environmental protections in trading partner countries harm the competitiveness of U.S. businesses just as much as lax labor laws. Traders should therefore expect environmental issues to be front and center in future U.S. trade negotiations.
