CFIUS’ powers were greatly expanded by the 2018 Foreign Investment Risk Review Modernization Act and are continuing to evolve. Most recently, CFIUS issued its first penalty guidelines and the Biden Administration has directed that it consider of new list of national security risks when reviewing covered transactions.
