Background

The following proposed revocations and modifications of U.S. Customs and Border Protection classification rulings are included in the March 17, 2021, Customs Bulletin and Decisions. Comments on these proposed changes are due by April 16.

Interactive Displays

CBP is proposing to reclassify certain interactive displays (liquid crystal display video monitors containing a touch overlay, a central processing unit, speakers, and connectors for various signal inputs and outputs) as other automatic data processing machines under HTSUS 8471.41.01 (duty-free) rather than as combined input/output units under HTSUS 8471.60.10 (duty-free). CBP explains that users of these items can perform the functions of word processing, web surfing, email, spreadsheet manipulation, etc., which provide general purpose computing, but that the items also serve as a display and interactive medium for specific classroom programs. Ruling HQ H304416 would be revoked to reflect this change.

Nutritional Supplements

CBP is proposing to reclassify nutritional supplement gummies under HTSUS 2106.90.9897 (6.4 percent duty) rather than HTSUS 2106.90.9500 (10 percent duty). CBP explains that while these items contain more than 10 percent of sugar derived from sugar cane, they are not “principally of crystalline structure” or “in dry amorphous form” when imported and prepared for marketing to the ultimate consumer. Ruling NY N314621 would be revoked to reflect this change.

Textile Leg Coverings

CBP is proposing to reclassify certain textile leg coverings as articles similar to leggings and gaiters under HTSUS 6406.90.15 (14.9 percent duty) rather than as clothing accessories under HTSUS 6117. CBP explains that these items are similar to leggings and gaiters because they extend over the ankle and up to the knee, are secured to the shoe with a strap, and do not cover the entire foot. Rulings NY N086942, NY N080395, NY N003909, NY G88706, NY D85843, and NY D83322 would be modified to reflect this change.
