Chassis Probe
The Federal Maritime Commission has opened an investigation to determine if the Ocean Carrier Equipment Management Association and its members have altered their policies and practices as required by a cease-and-desist order issued earlier this year establishing the right of shipper and trucker choice in chassis provisioning for merchant haulage in four key U.S. markets. The FMC has received reports that chassis providers in Los Angeles/Long Beach, Chicago, Memphis, and Savannah are not complying with that order.
According to an agency press release, evidence of wrongdoing uncovered in this investigation may be used to seek an injunction in federal district court and may also be used by the FMC to initiate its own enforcement action and seek civil penalties for noncompliance. Further, the FMC notes that retaliation against a party for making a complaint is a separate offense that carries significant penalties.
OTI License Revocations
The FMC has given notice that the following ocean transportation intermediary licenses have been revoked. A revocation may occur after a license is surrendered voluntarily by the OTI or for failure to maintain a valid bond.
