Variable Valve Actuation Devices. The International Trade Commission has instituted an investigation to determine whether imports of certain variable valve actuation devices and automobiles containing same are violating Section 337 of the 1930 Tariff Act by reason of patent infringement. The products at issue include certain types of valves that open and close with variable timing that are typically found in combustion automobile engines and vehicles with such engines.
Complainant Jacobs Vehicles Systems Inc. requests that after this investigation the ITC issue a limited exclusion order, which would direct U.S. Customs and Border Protection to prohibit the entry of the infringing products into the U.S., and cease and desist orders, which would require the named respondents to cease actions that violate Section 337, including selling infringing imported articles out of U.S. inventory. The respondents in this investigation are located in Mexico, Italy, Serbia, the United Kingdom and the U.S.
Soft-Edged Trampolines. The ITC has terminated without the imposition of import restrictions patent infringement investigation 337-TA-908 of certain soft-edged trampolines and components thereof. The ITC determined that no violation of section 337 was proven in this investigation because, among other things, complainants Springfree Trampoline Inc., Springfree Trampoline USA Inc. and Spring Free Limited Partnership did not satisfy the economic prong of the domestic industry requirement.
