Background

U.S. Customs and Border Protection at the port of Los Angeles/Long Beach is reminding vessel carriers, non-vessel-operating common carriers and marine terminals that it maintains a zero tolerance policy for “gateouts,” or the release of containers/cargo targeted for terrorism or enforcement reasons without CBP authorization or examination. CBP states that it continues to experience gateouts and that civil monetary penalties are being assessed for each such incident against all culpable parties, with only limited mitigation. In addition, enforcement activities may be conducted against violators, including stationing CBP officers at terminal exit points to ensure compliance.
