Background

In the Aug. 19, 2020, Customs Bulletin and Decisions, U.S. Customs and Border Protection is proposing to reclassify network devices known as access points as other machines for data transmission under HTSUS 8517.62.0090 (duty-free) rather than as switching and routing apparatus under HTSUS 8517.62.0020 (duty-free). CBP explains that to be classified as switching or routing apparatus a device must perform switching or routing itself and not merely rely on an external switching or routing device, as is the case here. Ruling NY N301462 would be modified to reflect this change.
