Background

In the Jan. 4, 2023, Customs Bulletin and Decisions, U.S. Customs and Border Protection is reclassifying cast-iron cylinder heads and block castings under HTSUS 8409.99.10 (duty-free) rather than under HTSUS 8409.99.9190 (2.5 percent duty).

The items at issue are designed to be used with heavy-duty diesel vehicle engines. CBP states that they are only classifiable under HTSUS 8409.99.10 if they are not advanced beyond cleaning. CBP now finds that painting the block castings with primer and coating the cylinder heads with oil, which are done only to prevent oxidation during transport, do not advance the products beyond being cleaned.

Ruling HQ H317007 will revoke ruling NY N312073 to reflect this change, effective with respect to goods entered or withdrawn from warehouse for consumption on or after March 5.
