Background

A new International Trade Commission investigation of the economic impact of Section 232 and Section 301 tariffs on U.S. industries could have some effect on the Biden administration’s decision on whether to retain, modify, or eliminate those tariffs.

The ITC said its final report will include detailed information on U.S. trade, production, and prices in the industries directly and most affected by the Section 232 and Section 301 tariffs that were in effect as of March 15, 2022. These include Section 301 tariffs on hundreds of billions of dollars’ worth of imports from China (which are currently under review by the Office of the U.S. Trade Representative) and Section 232 tariffs on imports of steel and aluminum products from most countries (though many major U.S. trading partners have been exempted).

The ITC will hold a public hearing in connection with this investigation on July 21. Requests to appear at the hearing are due by July 6, all pre-hearing briefs and statements are due by July 8, and all post-hearing briefs and statements are due by Aug. 12. In lieu of or in addition to participating in the hearing, interested parties may file written submissions no later than Aug. 24.
