Background

The Consumer Product Safety Commission is accepting comments through Aug. 25 on separate proposed rules that would codify bans on crib bumpers and inclined infant sleepers pursuant to the Safe Sleep for Babies Act of 2021. The CPSC is also terminating a rulemaking proceeding that would have issued a mandatory safety standard for crib bumpers.

Under the SSBA crib bumpers and inclined infant sleepers, regardless of the date of manufacture, are to be considered banned hazardous products under the Consumer Product Safety Act no later than 180 days after the SSBA’s enactment on May 16 (i.e., mid-November).

Crib bumpers are defined as any material intended to cover the sides of a crib to prevent injury to any crib occupant from impacts against the side of a crib or to prevent partial or complete access to any openings in the sides of a crib to prevent a crib occupant from getting any part of the body entrapped in any opening. Covered items include padded crib bumpers, supported and unsupported vinyl bumper guards, and vertical crib slat covers. Non-padded mesh crib liners are not included.

Inclined infant sleepers are defined as products with an inclined sleep surface greater than ten degrees that are intended, marketed, or designed to provide sleeping accommodations for an infant up to one year old.
