The following proposed revocations and modifications of U.S. Customs and Border Protection classification rulings are included in the June 23, 2021, Customs Bulletin and Decisions. Comments on these proposed changes are due by July 23.

Motion Sensors
CBP is proposing to reclassify Wi-Fi infrared motion sensors as other electric visual signaling apparatus under HTSUS 8531.80.90 (duty-free) rather than as other electrical machines and apparatus under HTSUS 8543.70.4000 (2.6 percent duty). CBP explains that because the sensors feature an integrated LED light that flashes rapidly to visually signal when motion is detected they are prime facie classified as electric visual signaling apparatus. Ruling NY N255515 would be modified to reflect this change.
Sound Amplifiers
CBP is proposing to reclassify hearing amplification devices as audio-frequency electric amplifiers under HTSUS 8518.40.20 (duty-free) rather than as hearing aids under HTSUS 9021.40.00 (duty-free). CBP explains that these items are personal sound amplifiers rather than hearing aids because they (1) are not specifically intended to compensate for hearing loss, (2) amplify all sounds rather than specific sounds, and (3) are not available with advanced features or custom programmed. Rulings NYN283085, NY N166443, NY N025447, and NY D80822 would be revoked to reflect this change.
