Background

Legislation to create one national “Made in USA” labeling standard was reintroduced Feb. 8 by Sens. Mike Lee (R-Utah) and Angus King (I-Maine). Similar legislation was approved by the Senate Committee on Commerce, Science, and Transportation in 2020.

“Some states have made it unnecessarily difficult for businesses to use the ‘Made in USA’ label and empowered trial lawyers to get rich through differing labeling standards,” said Sen. Lee in a press release. The Reinforcing American-Made Products Act (S. 297) would address this problem by giving the federal government exclusive authority to regulate the extent to which a product is introduced, delivered for introduction, sold, advertised, or offered for sale in interstate or foreign commerce with a “Made in the USA” or “Made in America” label, or the equivalent thereof, to represent that the product was in whole or substantial part of domestic origin.
