Trade Policy. The U.S. Trade Leadership in the Indo-Pacific and China Act (H.R. 6114, introduced Dec. 1 by Rep. Miller, R-W.V.) would (1) encourage reauthorization of trade promotion authority, (2) direct the White House to consider joining the Comprehensive and Progressive Agreement on Trans-Pacific Partnership and negotiating, modernizing, and/or updating bilateral trade agreements in the Indo-Pacific region, (3) specify that such agreements should cover issues such as free flow of commerce, market access, tariffs, intellectual property, investment, worker rights, e-commerce, automobiles, state-owned enterprises, and government procurement, and (4) direct the Office of the U.S. Trade Representative to articulate a long-term trade plan with China as the Phase One agreement comes to a close.
China. The Protect American IPR Act (H.R. 6128, introduced Dec. 2 by Rep. Gohmert, R-Texas) would (1) direct USTR to determine the amount of revenue lost each year due to intellectual property rights violations by China or any Chinese governmental entity and (2) impose duties on goods from China equivalent to that loss of revenue.
AD/CV Laws. The Level the Playing Field Act 2.0 (H.R. 6121, introduced Dec. 2 by Rep. Sewell, D-Ala.) would strengthen U.S. trade remedy laws by (1) making it easier for petitioners to bring new cases when production moves to another country, (2) authorizing the Department of Commerce to apply CV duty law to subsidies provided by a government to a company operating in a different country, and (3) imposing statutory requirements for anti-circumvention inquiries of AD/CV duty orders.
Haiti. S. 3279 (introduced Nov. 30 by Sen. Rubio, R-Fla.) and H.R. 6136 (introduced Dec. 2 by Rep. Salazar, R-Fla.) would reauthorize through 2035 the Haitian Hemisphere Opportunity through Partnership Encouragement (HOPE) Act, which removes duties on imports of apparel from Haiti, and the Haitian Economic Lift Program (HELP) Act, which broadens the types of goods eligible for duty-free status.
Supply Chains. The National Manufacturing Extension Partnership Supply Chain Database Act (S. 3290, introduced Dec. 1 by Sen. Menendez, D-N.J., and H.R. 6118, introduced Dec. 1 by Rep. Torres, D-Calif.) would establish a national database with information about the interconnectivity of manufacturers in the U.S. supply chain. Menendez said this database would help prevent future supply chain disruptions by offering manufacturers information as they decide how to retool in critical areas to meet demand for key products such as defense supplies, food, and medical devices.
