Background

In the April 14, 2021, Customs Bulletin and Decisions, U.S. Customs and Border Protection is proposing to reclassify air springs as other articles of vulcanized rubber under HTSUS 4016.99.55 (2.5 percent duty) rather than as motor vehicle parts and accessories under HTSUS 8708.99.55 (2.5 percent duty).

This item is an air cushion system designed to dampen road vibrations and shocks transmitted from a truck frame to the passenger compartment. It is situated between the frame and the wheel axle and functions as an integral part of the suspension system. It consists of a metal bead plate, a flexible bellow made of vulcanized rubber reinforced with nylon cord, and a rubber bumper and metal piston mount. It does not include any sort of metal spring.

CBP explains that because the air springs are classified under heading 4016 they are excluded from heading 8708 by Section XVII Note 2(a).

Ruling NY R01224 would be modified to reflect this change. Comments on this proposed change are due by May 14.
