Background

The following proposed revocations of U.S. Customs and Border Protection rulings are included in the Oct. 28, 2020, Customs Bulletin and Decisions. Comments on these proposed changes are due by Nov. 27.

Chai Teas

CBP is proposing to modify ruling NY N306886 to state that (1) one variety of instant chai teas is classified under HTSUS 2101.20.58 (30.5 cents/kg + 8.5 percent duty) rather than HTSUS 2101.20.54 (10 percent duty), is eligible for preferential treatment under NAFTA, and qualifies to be marked as a good of Mexico under the NAFTA marking rules, and (2) the country of origin for marking purposes of four other instant chai tea varieties is Kenya instead of the U.S.

Plant Distillation Refining Module

CBP is proposing to reclassify a plant distillation refining module as machinery for liquefying air or other gases under HTSUS 8419.60.50 (duty-free) rather than as machinery for treating materials by drying under HTSUS 8419.89.9585 (4.2 percent duty). This item consists of interconnected components that include reboilers, condensers, pumps, drums, and interconnected pipes. Ruling NY N300353 would be revoked to reflect this change.

Piggy Banks

CBP is proposing to reclassify plastic piggy banks as plastic household objects under HTSUS 3924.90.56 (3.4 percent duty) rather than as toys under HTSUS 9503.49.00 (duty-free). CBP explains that the physical features of these banks are not characteristic of a toy, any amusement they provide is incidental to their utilitarian purpose, and they do not promote pretend and role play. Rulings NY I87269, NY D84404, NY 816190, NY N005466, NY C85171, and NY L86796 would be revoked, and ruling NY L82296 would be modified, to reflect this change.

Range Extenders

CBP is proposing to reclassify network devices known as range extenders as other machines for the reception, conversion, and transmission or regeneration of voice, images, or other data under HTSUS 8517.62.0090 (duty-free) rather than as switching and routing apparatus under HTSUS 8517.62.0020 (duty-free). CBP explains that these items do not perform switching or routing themselves and instead rely on an external switching or routing device. Ruling NY N300883 would be revoked to reflect this change.
