Background

The following final revocations and modifications of U.S. Customs and Border Protection rulings are included in the Nov. 4, 2020, Customs Bulletin and Decisions. These changes will be effective with respect to goods entered or withdrawn from warehouse for consumption on or after Jan. 3, 2021.

CBP is reclassifying network devices known as access points as other machines for data transmission under HTSUS 8517.62.0090 (duty-free) rather than as switching and routing apparatus under HTSUS 8517.62.0020 (duty-free). Ruling HQ H304471 will modify ruling NY N301462 to reflect this change.

CBP is also reclassifying wireless network range extension devices (known as powerline adapters) under HTSUS 8517.62.0090 rather than under HTSUS 8517.62.0020. Ruling HQ H307923 will revoke rulings NY N304478 and N300884 to reflect this change.

In both cases CBP explained that to be classified as switching or routing apparatus a device must perform switching or routing itself and not merely rely on an external switching or routing device, as is the case here.
