The Bureau of Industry and Security has issued a temporary final rule granting limited relief from the import quota for semi-finished steel products from Brazil, which was lowered in September through the end of the year. This relief will be available from Oct. 13 through Dec. 31 for up to 60 million kilograms of affected goods. However, it will only be granted upon receipt of a sworn statement signed by the CEO and chief legal officer of the party requesting relief attesting that the following criteria have been met.
- the party entered into a contract or other written agreement for the production and shipment of the steel article before Aug. 28, 2020
- that agreement specifies the quantity of the steel article that is to be produced and shipped to the U.S. prior to Dec. 31, 2020
- the steel article is to be used in production activities in the U.S. and cannot be procured from another supplier to meet the delivery schedule and specifications contained in the agreement
- lack of relief on the steel article would significantly disrupt the production activity in the U.S. for which the steel article specified in such agreement is intended
