Hazardous Materials Compliance & Defense
ST&R provides strategic counsel to domestic and international clients on compliance with transportation and hazardous materials regulations as well as related congressional and executive branch policy. The firm has a successful track record representing automotive, aviation and transit companies, parts suppliers (e.g., airbags and lithium batteries), oilfield service companies, and metals and chemicals manufacturers.
Our comprehensive and cross-practice experience includes advising clients on policy, program and regulatory issues concerning hazmat, transit, aviation and ports. We represent clients in a broad range of often intersecting compliance and regulatory matters before U.S. agencies, including the Department of Transportation the Federal Aviation Administration, the Federal Highway Administration, the Federal Motor Carrier Safety Administration, the National Highway Traffic Safety Administration, the Department of Homeland Security, the Environmental Protection Agency and the Treasury Department’s Bureau of Alcohol, Tobacco, Firearms and Explosives. Our representation extends to matters involving international competent authorities (e.g., Canada’s Explosives Regulatory Division) and scientific institutes such as BAM Federal Institute for Materials Research and Testing.
We have counseled companies on compliance in the movement of dangerous goods under the DOT’s Hazardous Materials Regulations as well as corresponding international rules such as the International Civil Aviation Organization’s Technical Instructions and the International Air Transport Association’s Dangerous Goods Regulations. Our services include helping companies secure hazmat transportation clearances (e.g., EX approvals and special permits) from the DOT and serving as designated agents for international clients with the DOT. In addition, we advise clients on obtaining interpretations, handling investigations and enforcement, addressing safety issues and navigating the federal licensing process, including any overlapping export controls compliance.
ST&R also counsels companies on domestic sourcing requirements under “Buy America” and related legislation, assists with efforts to comply with safety regimes implemented by the Transportation Security Administration and the requirements of the DHS SAFETY Act, and advises clients with regard to the DHS chemical facility anti-terrorism standards.
