Export Jurisdiction and Classification Determination Basics
When handling an export transaction, it is critical to understand whether the export is subject to the jurisdiction of the Bureau of Industry and Security or the Directorate of Defense Trade Controls. Items of a dual-use nature (i.e., those with both commercial and defense applications) are subject BIS jurisdiction and classified under the Commerce Control List pursuant to the Export Administration Regulations. Defense articles are subject to DDTC jurisdiction and classified under the U.S. Munitions List pursuant to the International Traffic in Arms Regulations. Exporters must understand issues related to jurisdiction and product classification and the impact these have on whether or not an export license is required. This webinar will discuss how exporters can identify the agency with jurisdiction over their products, how to classify their products, how to know when an export license is required, and, if so, how to obtain it.
