Duty Drawback: Preparing for the Transition to ACE and TFTEA Amendments
February 23rd is “Drawback Eve”- the day before the implementation of the greatest changes to occur in drawback since its inception in 1789. On February 24th, U.S. Customs and Border Protection will transition the filing and processing of drawback claims to the Automated Commercial Environment, taking what has been a largely paper process and making it completely electronic. On the same day, significant amendments to the drawback law ushered in by the Trade Facilitation and Trade Enforcement Act will become effective, among other things allowing for more relaxed drawback substitution and a changed statutory timeframe. However, claimants will be filing for refunds under the new law without implementing regulations, which have been delayed.
